
ExcaliburPoker owner responds to MGM claims
Adam Majewski files motion for dismissal on grounds that site doesn't infringe on MGM's trademark.

One of the domain owners accused by MGM of trademark infringement has filed a motion for dismissal.
Adam Majewski, who owns the excaliburpoker.com domain, argues that his site does not infringe on the Nevada-facing casino operator’s Excalibur casino trademark.
According to Vegas Inc, Majewski’s claims there is no threat of competition on the grounds that MGM’s Excalibur hotel does not offer online gambling, while adding that his various egaming sites do not target customers in Nevada.
Majewski, who has owned excaliburpoker.com since 2005 and owns other sites including DallasFreePoker.com, said “I specifically left off Las Vegas, Reno and Henderson as I concluded that individuals that could already gamble for real money would not want to play for prizes valued at a few dollars.”
He adds that: “Excalibur is not a distinctive mark… Thousands of businesses use this name,” and alleges that “Late to the [egaming] feeding frenzy, MGM wants to leverage the well-known names of its hotels in Las Vegas.”
No news has yet emerged with regard to the owners of the other domains targeted in the MGM suit, which include mgmpoker.com and ariapoker.com.
