Betting giant loses two-year case over legality of account restrictions in Spain


Bet365 has been ordered to unrestrict the accounts of a group of users from the Spanish town of Caravaca de la Cruz.
A Madrid court ruled last week that account restrictions were a form of discrimination and detrimental to consumers. Specifically, the judge ruled that the term allowing the restriction of winning bettors was a so-called “abusive clause”.
The court judgement noted: “A winning betting profile should not be subject to the establishment of abusive conditions without any other circumstance that justifies and sustains them.”
The ruling only applies to the original group of 48 users who sued bet365, and any other users who want their account restrictions removed will have to go through a similar legal process, which took two years.
A case to have the clause removed for all bettors was rejected.

Lawyer Borja Fernández, who represented the group of bet365 users, told local news outlet la Opinion de Murcia that bookmakers would be “forced to do something”, as the number of users who enforced their rights grew.
Bet365 declined to comment.
My understanding is that at least 2 of the 3 cases were appeals anyway. Apparently 365 has said they won't appeal the main case again (x48 people). Yes, it's true each person has to challenge in the future, but there is already a legal company offering to do it for all.
