
Betano ordered to refund player by German court following loss limit failure
Sportsbook brand ordered to return €4,380 to the player following a lawsuit


Kaizen Gaming-owned operator Betano has been ordered by the district court of Ludwigslust to refund a player €4,380 (£3,735) after letting the player play beyond the national €1,000 loss limit.
The player lost €5,380 on the sportsbook between 20 February and 4 March 2021. This is over five times the limit allowed under Germany’s State Treaty on Gambling. There are exceptions to this but this case did not fall into this category.
Lawyer István Cocron, who is representing the player in question, informed the court that the player was registered on the OASIS player blocking system due to his gambling addiction.
The court concluded that the gaming contract had ended between the operator and the player as per Section 134 of the German Civil Code in conjunction with Section 21 (5) of the State Treaty on Gaming
Cocron said: “The provider allowed our client to bet more than the permitted €1,000 per month and thus violated the gaming licence granted to them.
“We have therefore reclaimed the stakes that go beyond the limit of €1,000.”
Cocron went on to say that this might not be the only case like this in the future: “Both in online sports betting and online gambling, which was subject to a far-reaching ban in Germany until the end of June 2021, there is a good chance of winning back stakes that seem to have been lost.”
